EUB Examiners Report E98-06 on application no. 970251 by Penn West for well licence to drill in Lsd 16 Sec 5 Twp 31 Rge 23 W4M to obtain oil production from the Twining Mannville Ostracod Fm; Well Licence No. 0195726 was issued 1996-12-20 on the understanding that there were no outstanding issues related to the well that fall with the EUB's jurisdiction; Subsequently a submission was received from Terry and Marlene Mullinger, adjacent landowners objecting to the well; A public hearing was held 1997-05-14; Examiner Report E97-05 recommended that the well licence remain in good standing subject to condition; The Mullingers sought and obtained leave to appeal the decision to the Court of Appeal on the issue of whether they had been given an adequate opportunity to evaluate and rebut expert evidence filed by Penn West on the day of the hearing; Penn West requested that the Board re-open the hearing to afford the Mullingers to present new evidence in rebuttal to the technical evidence it presented at the original hearing; The Board directed that the hearing be re-opened; In the intervening period, Well Licence No. 0195726 was cancelled in a routine procedure and re-issued as Well Licence 0213751.
